We help the music industry in the enforcement of music copyright under the copyright act of 1957.

ONICRA Credit Rating Agency of India Limited is empanelled with Phonographic Performance Limited, which is a copyright Society registered with the Government of India, Ministry of HRD, Copyright Division. Phonographic Performance Limited administers the Broadcasting, Telecasting and Public Performance Rights on behalf of more than 80% of Indian Music Companies as well as Foreign Member Music Companies. This includes communication of music to public in any form – acoustic or visual, by way of radio, world space receiver, T.V. or a cable network, and issues Public Performance License on behalf of them.

Public Performance License is issued if one communicates music to the public or play music recordings for commercial purposes. Any performance of Indian or International music, from sound Recordings in public places or commercial establishments, rendered without first having obtained a License from us constitutes an infringement of copyright under the Copyright Act of 1957. In case of non-compliance the concerned defaulter would be charged with the violation of the Copyright Act 1957 and cognizable, non-bailable offence attracts a heavy penalty.

ONICRA as a representative of PPL educates people of commercial areas like discotheques, lounge bars, hotels, shops, cinemas, amusement parks etc. about PPL, that it is a legal and mandatory requirement according to the Copyright Act 1957. They inform them of the consequences of not obtaining the requisite license for using the sound recordings in the Public Places or commercial establishments vis-à-vis Statutory Provisions, and thereafter informing them about all the tariff of their concerned category and collect the license fees.

Copyright is a bundle of rights, which comprises the right to authorize reproduction of the sound recording, the performance of the sound recording in public, its broadcast and inclusion in a program service. In practice, no copyright owner administers his copyright alone. As it is beyond the ability of any individual record manufacturer to authorize every use of his sound recording or to enforce his rights effectively with every potential music user worldwide. Collective societies were established to authorize the use of sound recordings and to negotiate their terms of remuneration with high volume users.

So here is a grand step being taken by ONICRA to make the civilians to be aware of the rules and regulations made by the government to administer the Broadcasting, Telecasting, and Public Performance rights, thereby giving a dynamic support to the Phonographic Performance Limited and Indian Music Industry as well as the Government of India. The Indian music industry says it loses several crores every year due to non-payment of license fee by hotels and pubs across, so hereby we are trying to reduce the burden off the shoulders of the government.
